    Forse il movimento No-Tav può essere considerato una sommossa? O tutti coloro che si battono perché non vengano costruite centrali atomiche o cancro-valorizzatori (leggi inceneritori)?

Uno “stato europeo” presumerebbe l’accordo dei popoli d’Europa. Solo i cittadini hanno il diritto di decidere se vogliono trasferire il potere dello Stato alla UE e se così fosse, in quale misura. Contrariamente alla Legge fondamentale, si evitò un referendum su Lisbona perchè il governo sa molto bene che la maggioranza dei cittadini avrebbero votato contro questo trattato. Ma non consultare il popolo è contrario alla clausola di non modificazione dell’art. 79 comma 3 GG: “Non è consentita nessuna modificazione della presente Legge fondamentale che si riferisca the organization of the federation in the provinces, or the principle of participation of the Länder in the legislative, or the principles set out in Articles 1 and 20.
